Proving a Misdiagnosis Case

Not every bad outcome is malpractice. Under Florida law, we must show that the provider failed to meet the accepted standard of care — what a reasonably careful provider would have done under similar circumstances — and that this failure caused harm. That typically requires testimony from a qualified medical expert in the same specialty, plus a clear link between the delay and a worse outcome, such as a cancer that progressed from treatable to terminal.

Florida’s Pre-Suit Requirements

Medical malpractice claims in Florida must go through a mandatory pre-suit process under Chapter 766 before a lawsuit can be filed: a Notice of Intent served on each prospective defendant, a 90-day pre-suit investigation period, and a verified written medical expert opinion supporting the claim. Missing these steps can doom an otherwise valid case.

Strict Deadlines Apply

Florida generally requires medical malpractice lawsuits to be filed within two years of when the malpractice was discovered (or should have been discovered), with an outer limit of four years in most cases.
